If you have sustained an injury as the result of another person’s fault or negligence, going through the claim process can be like adding insult to injury. Because of the complexity of the process, it is a good idea to get help from a Vancouver ICBC lawyer. Our lawyers at Taylor and Blair are specialized in this type of law, and will help you every step of the way. To help you understand the basic process, we’ve broken it down into four steps. If you have more questions, or are in need of legal advice, contact one of our lawyers—we’ll help you get the compensation you deserve. You should know that the insurance company has their own ICBC lawyers working for them; our team of lawyers will work for you.
Step One: Submit Your Claim—The first and most basic step to filing a personal injury claim is to actually submit the claim and this can be done with the assistance of the lawyers at Taylor and Blair. Each situation differs, depending on whether or not the other party is insured in B.C or out of province.
Step Two: Provide Evidence—The insurance company will appoint an adjuster to verify your claim. At this time, you will be asked to provide proof which will support your claim. This step is important, because if you fail to provide adequate proof regarding the severity of the injuries you sustained, the negligence of the responsible party, and the resulting loss of income and medical/repair expenses, your claim may be denied. At some point the adjuster may try to offer you a lower amount of compensation than you deserve. Be sure to consult with an ICBC lawyer before accepting a settlement offer.
Step Three: Negotiate—When you team up with one of our ICBC lawyers, we will negotiate with the insurance companies before filing a lawsuit. We will do our best to reach a mutual agreement with the other party that will get you the compensation you deserve without putting you through the lengthy process of a trial.
Step Four: File a Lawsuit— if a reasonable agreement can’t be reached, we will file a lawsuit and take your case to trial where a judge will render a judgment. This can be a lengthy process but we will move it along as quickly as possible. At Taylor and Blair, we will do our best to get you a fair settlement without going to court, but will be there with you to fight for the compensation you deserve should the case necessitate a trial.
