How to file a Personal Injury Claim

     Step One: Submit Your Claim—The first and most basic step to filing a personal injury claim is to actually submit the claim and this can be done with the assistance of the lawyers at Taylor and Blair. Each situation differs, depending on whether or not the other party is insured in B.C or out of province.

     Step Two: Provide Evidence—The insurance company will appoint an adjuster to verify your claim. At this time, you will be asked to provide proof which will support your claim. This step is important, because if you fail to provide adequate proof regarding the severity of the injuries you sustained, the negligence of the responsible party, and the resulting loss of income and medical/repair expenses, your claim may be denied. At some point the adjuster may try to offer you a lower amount of compensation than you deserve. Be sure to consult with an ICBC lawyer before accepting a settlement offer.

     Step Three: Negotiate—When you team up with one of our ICBC lawyers, we will negotiate with the insurance companies before filing a lawsuit. We will do our best to reach a mutual agreement with the other party that will get you the compensation you deserve without putting you through the lengthy process of a trial.

     Step Four: File a Lawsuit— if a reasonable agreement can’t be reached, we will file a lawsuit and take your case to trial where a judge will render a judgment. This can be a lengthy process but we will move it along as quickly as possible.
